1. INTRODUCTION
Predictive Sports, LLC ("Predictive Sports," "we," "us," or "our") provides the PitchIQ mobile application and related online services (collectively, the "Services"). We respect your privacy, and this Privacy Policy explains what information we collect through the Services, how we use and share it, how we protect it, and the choices and rights you have.
This Privacy Policy applies to information we collect through the Services. It does not apply to information collected by third parties, including through any third-party services or applications you access through the Services.
By creating an account or using the Services, you acknowledge that you have read and understood this Privacy Policy. Please also review our Terms of Service, which govern your use of the Services.
2. CHILDREN AND FAMILIES (MIXED-AUDIENCE SERVICE)
PitchIQ is a mixed-audience service used by baseball and softball players of varying ages — including children under 13 — together with their parents, guardians, and coaches. We built the Services around data minimization for young users, and we comply with the Children's Online Privacy Protection Act ("COPPA") with respect to users under 13.
When the Services are first set up, a neutral age screen asks for a date of birth and, based on it, applies one of three account types:
- Adults (18+) hold their own account.
- Teens (13–17) hold their own account under additional data-minimization defaults, with the involvement of a parent, legal guardian, or coach.
- Children (under 13) do not create or hold their own account. A parent, legal guardian, or authorized coach (an "Adult Sponsor," aged 18 or older) creates and controls the account on the child's behalf.
For a Child account, we do not collect personal information from the child. The account is created with the Adult Sponsor's email and password; within the Services the child is represented only by a non-identifying display name and by gameplay and progress data that we do not use to contact or identify the child. We use information associated with a Child account only to operate, support, secure, and improve the Services (internal operations), never for advertising, and we do not condition a child's participation on disclosing more information than is reasonably necessary.
Parents and Adult Sponsors may review the information associated with a Child's account, ask us to correct or delete it, and refuse to permit further collection or use — by deleting the account from within the app or by contacting us at privacy@predictivesports.io. See Section 9 (Your Choices and Rights) and Section 14 (Information for Parents and Adult Sponsors).
If you believe a child under 13 has used the Services without an Adult Sponsor, or has provided us with personal information, please contact us at privacy@predictivesports.io and we will take reasonable steps to delete that information.
3. INFORMATION WE COLLECT
3.1. Information You Provide to Us
- Account information: your email address and a password. Passwords are handled by our authentication provider and are not stored by us in plain text. For a Child (under 13) account, the email and password belong to the Adult Sponsor who created and controls the account, not to the child.
- Age and attestation information: your date of birth; your attestation that you are at least 13 years old and agree to our Terms of Service and Privacy Policy; the date and time of that attestation; and the version of each document you agreed to.
- Consent records: where supported, a record that you have agreed to use the Services, along with the date and time of that agreement.
- Communications: information you provide when you contact us for support or otherwise correspond with us.
3.2. Information Generated Through Your Use of the Services
- Gameplay and performance data: scenarios played, pitch calls, outcomes, scores, progress, training metrics, and similar information you generate while using the Services.
- Device and technical data: limited technical information such as app version, device type, and operating system version, used to operate, secure, and troubleshoot the Services.
We do not knowingly collect precise geolocation information, contacts, photos, or biometric information through the Services.
4. HOW WE USE INFORMATION
We use the information we collect to:
- create, maintain, and secure your account, and authenticate you;
- provide, operate, maintain, and improve the Services and your training experience;
- save and synchronize your progress across sessions and devices;
- enforce our age requirement and maintain a record of your age attestation and consent;
- respond to your support requests and communicate with you about the Services;
- monitor for, prevent, detect, and address fraud, abuse, security incidents, and violations of our Terms; and
- comply with our legal obligations and enforce our agreements.
We do not use the personal information of users we know to be minors for targeted advertising, and we do not sell personal information.
5. HOW WE SHARE INFORMATION
We do not sell your personal information and do not share it for cross-context behavioral advertising. We disclose information only as described below:
- Service providers: we use trusted third parties that process information on our behalf to operate the Services, including authentication and database hosting (for example, Supabase for authentication and data storage) and our application hosting provider. These providers are authorized to use personal information only as necessary to provide services to us.
- App stores: when you obtain or use the App through a third-party app store (such as the Apple App Store), that app store may collect and process information under its own privacy policy.
- Legal and safety: we may disclose information if we reasonably believe it is required by law or legal process, or necessary to protect the rights, property, or safety of our users, the public, or Predictive Sports.
- Business transfers: if we are involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to the commitments in this Privacy Policy.
- With your direction: we may share information at your direction or with your consent.
6. ANALYTICS AND TRACKING
We use limited technical and diagnostic information to operate and improve the Services. We do not use the Services to track you across apps and websites owned by other companies for advertising purposes. Because there is no common industry standard for responding to "Do Not Track" signals, the Services do not currently respond to them.
7. DATA RETENTION
We retain personal information for as long as your account is active or as needed to provide the Services, and thereafter as necessary to comply with our legal obligations, resolve disputes, maintain security, and enforce our agreements. We retain age-attestation and consent records for as long as reasonably necessary to demonstrate compliance with applicable law. When information is no longer needed, we take reasonable steps to delete or de-identify it.
8. SECURITY
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
9. YOUR CHOICES AND RIGHTS
- Access and correction: you may review and update your account information within the Services or by contacting us.
- Account and data deletion: you may delete your account from within the app, or request deletion by contacting us at privacy@predictivesports.io. When you delete your account, we will delete or de-identify your personal information, except information we are permitted or required to retain by law.
- Communications: you may opt out of non-essential communications by following the unsubscribe instructions in those messages or by contacting us. We may still send you administrative or transactional messages about your account and the Services.
- Stopping collection: you can stop all further collection of information by the app by uninstalling it.
10. U.S. STATE PRIVACY RIGHTS
Depending on your state of residence, you may have additional rights regarding your personal information.
10.1. Notice at Collection (California)
In the preceding 12 months, we have collected the following categories of personal information, as defined by the California Consumer Privacy Act (as amended, the "CCPA"):
- Identifiers (such as email address and an account/user identifier);
- Characteristics of protected classifications under California or federal law (such as age and date of birth, used solely to enforce our age requirement);
- Commercial information (such as records of any purchases or subscriptions);
- Internet or other electronic network activity information (such as app interactions and gameplay data); and
- Inferences drawn to provide training metrics and progress within the Services.
We collect this information for the purposes described in Section 4 and disclose it to the categories of recipients described in Section 5. We retain it as described in Section 7. We do not sell personal information and do not share it for cross-context behavioral advertising, and we have not done so in the preceding 12 months. We do not knowingly sell or share the personal information of consumers under 16 years of age.
10.2. Your Rights
Subject to applicable law and verification of your identity, you may have the right to:
- know and access the personal information we have collected about you, and how we have used and disclosed it;
- request correction of inaccurate personal information;
- request deletion of your personal information;
- obtain a copy of your personal information in a portable format; and
- not receive discriminatory treatment for exercising your rights.
States including California, Virginia, Colorado, Connecticut, Utah, Texas, and others provide some or all of these rights. To exercise any of these rights, contact us at privacy@predictivesports.io. We will verify your request using the information associated with your account. You may use an authorized agent to submit a request on your behalf, subject to verification. If we deny your request, you may appeal by replying to our response; if you have concerns about the outcome, you may contact your state attorney general.
11. INTERNATIONAL USERS
The Services are operated from, and your information is processed and stored in, the United States. If you access the Services from outside the United States, you understand that your information will be transferred to, and processed in, the United States, where data-protection laws may differ from those in your jurisdiction. By using the Services, you consent to that transfer and processing.
12. CHANGES TO THIS POLICY
We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above and make the updated policy available through the Services. If we make material changes, we will provide additional notice as required by applicable law. Your continued use of the Services after an update takes effect constitutes your acceptance of the revised Privacy Policy.

14. INFORMATION FOR PARENTS AND ADULT SPONSORS
This section summarizes how the Services handle information for Children under 13 and the rights available to their parents, legal guardians, and authorized coaches ("Adult Sponsors"). It supplements the rest of this Privacy Policy.
How a Child account works. A Child does not create or hold their own account. An Adult Sponsor (18 or older) creates the account using the Adult Sponsor's own email and password, agrees to our Terms of Service, and supervises the Child's use of the Services.
What we collect about a Child. We do not collect personal information from a Child. We do not ask a Child for their name, email address, phone number, photograph, precise location, or contact information, and the Child is identified within the Services only by a non-identifying display name. We do collect gameplay and progress information generated as the Child uses the Services (for example, scenarios played, pitch calls, outcomes, and scores) and limited technical data needed to operate and secure the Services. We use this information only for the internal operation, support, security, and improvement of the Services.
How we use and share it. We do not use a Child's information for targeted advertising, we do not sell it or share it for cross-context behavioral advertising, and we do not disclose it to third parties except the service providers that help us operate the Services (such as authentication and hosting), or as required by law or to protect safety, as described in Section 5.
Your rights as an Adult Sponsor. At any time, you may:
- review the personal information associated with the Child's account;
- request that we correct or delete that information; and
- refuse to permit further collection or use of the Child's information, by deleting the account.
You can delete the account and its associated data from within the app (Profile → delete account) or by contacting us at privacy@predictivesports.io. Because we do not collect a Child's own contact information, we work with you through the Adult Sponsor's account and contact details to verify and honor these requests.
